§ 7.05. SNOWMOBILE TRAILS .

    SNOWMOBILE DEFINED. "Snowmobile" means an engine-driven vehicle that is manufactured solely for snowmobiling that has an endless belt tread and sled-type runners, or skis, to be used in contact with snow.

    (2)

    USE RESTRICTIONS.

    (a)

    No person shall travel upon any County-designated snowmobile trail by any means other than a snowmobile or a vehicle being used for trail grooming and maintenance during the time of the year that such trail is in use as a snowmobile trail.

    (b)

    A landowner or any person authorized by the landowner is exempted from this section with respect to those portions of the trail on the landowner's property.

    (3)

    DAMAGING SURFACE OF TRAIL PROHIBITED. No person shall damage, mar or deface the surface or any other part of any County-designated snowmobile trail.

    (4)

    DEFACING OR REMOVING SIGNS PROHIBITED. No person shall damage, deface, destroy, obstruct or remove any snowmobile trail signs from any County-designated snowmobile trail.

    (5)

    BUSINESS SIGNS.

    (a)

    Permit Required . No person shall erect or maintain any business advertising sign on any snowmobile trail constituting a part of the County snowmobile trail system without first obtaining a permit from the County.

    (b)

    Types of Signs Permitted . Signs shall only be permitted for the purpose of directing trail users to places of business along the trail system. Information contained on signs shall be limited to names of businesses, international symbols pertaining to types of business, directional arrows and distances to businesses. Distance, where indicated, shall be reasonably accurate.

    (c)

    Location . Signs may be placed at trail heads, intersections and trail entrances to businesses only. They shall be erected on 4" x 4" wooden posts and located at least 2 feet to the right of STOP or other official signs.

    (d)

    Material . Signs shall be of material authorized by the County and have a white legend on a brown background. They shall be rectangular in shape and 12" x 30" in size. Sign letters shall be capital block letters 3 inches in height and directional arrows shall be the same size.

    (e)

    Compliance Required . Any sign placed on a trail within the County snowmobile trail system which is not in compliance with this subsection shall be removed.

    (f)

    Violations and Penalties . Any person in violation of this subsection shall be subject to the following:

    1.

    First Violation. A written warning and 5 days in which to correct the violation.

    2.

    Failure to Correct or Second Violation. A forfeiture of $50.00 plus statutory costs, assessments and fees.

    3.

    Subsequent Violations. A forfeiture of $100.00 plus statutory costs, assessments and fees.
